Physician Life Care Planning, LLC – Terms of Service

This Terms of Service Agreement (“Agreement”) is a legally binding contract between you (“you” or “your”) and Physician Life Care Planning, LLC (“PLCP”), a Texas limited liability company, governing your use of:

  • PLCP’s online systems, including software, methods, and procedures accessible via PhysicianLCP.com or any designated platform (the “Site”).
  • All content within the Site, including data, forms, and communications.
  • Any offline components provided by PLCP in connection with its services.
  • Any current or future products and services offered by PLCP, including but not limited to consulting, reports, data analysis, and professional evaluations (collectively, the “Services”).

By using the Site and Services, you agree to these terms in full. If you do not agree, please do not access or use the Site or Services.

  1. License & Acceptable Use

PLCP grants you a limited, non-exclusive, non-transferable license to access and use the Services solely for professional and lawful purposes. You agree not to:

  • Resell, sublicense, or commercially exploit the Service.
  • Copy, modify, or distribute Service content.
  • Interfere with security measures, hack, or reverse-engineer the Service.
  • Use the Service for unauthorized competitive analysis.
  • Share login credentials or allow unauthorized access.

Violating these terms may result in suspension or termination of your access.

  1. User Responsibilities

You are responsible for all activity occurring under your account. You agree to:

  • Maintain secure login credentials and prevent unauthorized access.
  • Notify PLCP immediately of any security breaches or unauthorized activity.
  • Comply with all applicable data privacy laws, including HIPAA, CCPA, and GDPR.

PLCP reserves the right to monitor and investigate compliance with these terms.

  1. Data Privacy & Confidentiality
  • HIPAA Compliance: If you access protected health information, you must ensure compliance with HIPAA regulations.
  • GDPR & CCPA: Users from applicable jurisdictions have the right to request data access, corrections, and deletions.
  • Third-Party Data Sharing: PLCP does not sell personal data but may share necessary information with service providers under strict confidentiality agreements.
  1. Intellectual Property & User Content
  • All software, logos, and trademarks remain PLCP’s property.
  • User-submitted content remains your property, but by submitting, you grant PLCP a license to use it for service functionality and improvement.
  • PLCP may use aggregated and anonymized data for research and analytics.
  1. Service Availability & Modifications
  • PLCP does not guarantee uninterrupted access and may modify or discontinue services with notice.
  • Scheduled maintenance may temporarily impact service availability.
  • Users will receive advance notification of major policy changes via email or platform alerts.
  1. Account Termination & Suspension

PLCP reserves the right to suspend or terminate accounts for:

  • Violations of these Terms.
  • Unauthorized access or security breaches.
  • Non-payment (if applicable).
  • Legal or regulatory requirements.

Users will generally receive a warning before termination, except in cases of severe breaches.

  1. Dispute Resolution & Governing Law
  • Any disputes shall be resolved through binding arbitration in San Antonio, Texas.
  • Class action waivers apply, meaning disputes will be handled individually.
  • The Agreement is governed by Texas law.
  1. Limitation of Liability

PLCP is not liable for:

  • Indirect or consequential damages.
  • Loss of profits, data, or business opportunities.
  • Service interruptions due to maintenance or unforeseen issues.

Total liability under this Agreement shall not exceed the amount paid for the Services in the past 12 months.

  1. Updates to Terms

PLCP reserves the right to update these Terms at any time. Users will receive reasonable notice of significant changes.
